By accessing and placing an order with THE Levels, you confirm that you are in agreement with and bound by the terms of service contained in the Terms of Use outlined below. These terms apply to the entire website, application, and any email or other type of communication between you and THE Levels.
Under no circumstances shall the THE Levels team be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials or services on this platform, even if the THE Levels team or an authorized representative has been advised of the possibility of such damages. If your use of materials or services from this platform results in the need for servicing, repair, or correction of equipment or data, you assume any costs thereof.
THE Levels will not be responsible for any outcome that may occur during the course of usage of our resources. All results, including but not limited to test scores, skill assessments, or recommendations, are generated by artificial intelligence (AI) and are provided for informational purposes only. We do not guarantee the accuracy, reliability, or suitability of these AI-generated results, and THE Levels bears no responsibility for any decisions or actions taken based on such results. We reserve the right to change prices and revise the resources usage policy at any moment.
License
THE Levels grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the app strictly in accordance with the terms of this Agreement. These Terms of Use are a contract between you and THE Levels ("we," "our," or "us") and govern your use of the app.
Definitions and Key Terms
For these Terms & Conditions:
- Cookie: A small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, or remember information such as your language preference or login information.
- Company: When this policy mentions "Company," "we," "us," or "our," it refers to THE Levels, which is responsible for your information under this Terms & Conditions.
- Country: Where THE Levels or the owners/founders of THE Levels are based, in this case, Ukraine.
- Customer: Refers to the company, organization, or person that signs up to use the THE Levels Service to access testing and assessment services for English proficiency and soft skills.
- Device: Any internet-connected device such as a phone, tablet, computer, or any other device that can be used to access THE Levels and use the services.
- IP address: Every device connected to the Internet is assigned a number known as an Internet protocol (IP) address, which can often be used to identify the location from which a device is connecting to the Internet.
- Personnel: Refers to individuals who are employed by THE Levels or are under contract to perform a service on behalf of one of the parties.
- Personal Data: Any information that directly, indirectly, or in connection with other information—including a personal identification number—allows for the identification or identifiability of a natural person.
- Service: Refers to the service provided by THE Levels, including English proficiency and soft skills testing and assessment, as described in the relative terms (if available) and on this platform.
- Third-party service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.

- You: A person or entity that is registered with THE Levels to use the Services.
Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the service or make the platform available to any third party.
- Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the service.
- Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of THE Levels or its affiliates, partners, suppliers, or licensors of the service.
Payment
THE Levels offers several in-app purchase options that provide access to test attempts:
- Starter: includes 1 test attempt.
- Premium: includes 5 test attempts.
- Team: includes 10 test attempts.
- Corporate: includes 50 test attempts for company or team assessments.
- Ultimate: includes 100 test attempts for extended access.
If you purchase any of our plans, you agree to pay all fees or charges to your account for the Service in accordance with the fees, charges, and billing terms in effect at the time that each fee or charge is due and payable. You must provide us with a valid credit card (Visa, MasterCard, or any other issuer accepted by us) or other accepted payment method ("Payment Provider") as a condition to purchasing any plan. Your Payment Provider agreement governs your use of the designated payment method, and you must refer to that agreement to determine your rights and liabilities. By providing us with your payment information, you agree that we are authorized to verify information immediately and subsequently invoice your account for all fees and charges due and payable to us hereunder, and no additional notice or consent is required. You agree to immediately notify us of any change in your billing address or the payment method used for payment hereunder. We reserve the right at any time to change prices and billing methods, either immediately upon posting on our Site or by e-mail delivery to you. Any attorney fees, court costs, or other costs incurred in the collection of delinquent undisputed amounts shall be the responsibility of and paid for by you. No contract will exist between you and us for the Service until we accept your order by a confirmatory e-mail, SMS/MMS message, or other appropriate means of communication. You are responsible for any third-party fees that you may incur when using the Service.
Return and Refund Policy
We appreciate your use of THE Levels. We want to ensure you have a rewarding experience while exploring and using our testing services. By making a purchase from us, you agree to the terms along with our Privacy Policy. If, for any reason, you are not completely satisfied with any service we provide, please contact us at [email protected] and we will discuss any issues you are experiencing with our product. No refunds will be provided for partial or unused test attempts.
Your Suggestions
Any feedback, comments, ideas, improvements, or suggestions (collectively, "Suggestions") provided by you to us with respect to the service shall remain the sole and exclusive property of THE Levels. We shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or compensation to you.

Our service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We are not responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, or quality. Third-Party Services are provided solely as a convenience, and you access and use them at your own risk, subject to their terms and conditions.
Term and Termination
This Agreement remains in effect until terminated by you or us. We may suspend or terminate this Agreement at any time, for any reason, with or without prior notice. This Agreement will terminate immediately, without prior notice, if you fail to comply with any provision. You may terminate this Agreement by deleting the service and all copies from your device. Upon termination, you must cease all use of the service and delete all copies. Termination will not limit any of our rights or remedies at law or in equity in case of breach by you.
Copyright Infringement Notice
If you believe any material from us infringes your copyright, please contact us at [email protected] with: (a) a physical or electronic signature of the copyright owner or authorized person; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement that the information is accurate and you are authorized to act on behalf of the owner.
Indemnification
You agree to indemnify and hold THE Levels and its affiliates, officers, employees, agents, partners, and licensors harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your: (a) use of the service; (b) violation of this Agreement or any law; or (c) violation of any third-party right.
No Warranties
The service is provided "AS IS" and "AS AVAILABLE" with all faults and defects, without warranty of any kind. We expressly disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the service will meet your requirements, achieve intended results, be compatible with other software, operate without interruption, meet performance or reliability standards, or be error-free. We make no warranty that the AI-generated results, including test scores or assessments, are accurate, reliable, or suitable for any purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some limitations may not apply to you.
Limitation of Liability
Our liability and that of our suppliers under any provision of this Agreement is limited to the amount you paid for the service. To the maximum extent permitted by law, we shall not be liable for any special, incidental, indirect, or consequential damages, including damages for loss of profits, data, business interruption, or personal injury, arising out of the use of or inability to use the service or AI-generated results, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of incidental or consequential damages, so this limitation may not apply to you.
Severability
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.
Waiver
The failure to exercise a right or require performance under this Agreement does not affect a party's ability to exercise such right or require performance later. No waiver of a breach constitutes a waiver of any subsequent breach.
Amendments to this Agreement
We reserve the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice. By continuing to use our service after revisions become effective, you agree to be bound by the revised terms. If you do not agree, you are no longer authorized to use our service.
Entire Agreement
This Agreement, together with the Privacy Policy and any other legal notices published by us, constitutes the entire agreement between you and us concerning the Services. If any provision is deemed invalid by a court, the remaining provisions remain in effect.
Intellectual Property
Our platform and its contents, features, and functionality are owned by THE Levels, its licensors, or other providers and are protected by Ukraine and international copyright, trademark, patent, trade secret, and other intellectual property laws. The material may not be copied, modified, reproduced, downloaded, or distributed without our express prior written permission, except as provided in these Terms of Use.
Agreement to Arbitrate
This section applies to any dispute, except those relating to claims for injunctive or equitable relief regarding the enforcement or validity of your or THE Levels' intellectual property rights. "Dispute" means any controversy between you and us concerning the Services or this Agreement. You or we must send a Notice of Dispute to [email protected] or your provided address/email. We will attempt to resolve disputes through informal negotiation within 60 days. If unresolved, disputes will be settled by binding arbitration under the commercial arbitration rules of the American Arbitration Association. The prevailing party’s legal and other costs shall be borne by the non-prevailing party.
Submissions and Privacy
Any submissions, including ideas, suggestions, or designs, are treated as non-confidential and non-proprietary and become our sole property without compensation. We may use such submissions for any purpose in perpetuity.
Promotions
Promotions may be governed by separate rules with eligibility requirements. You are responsible for reviewing and complying with all Promotions rules.
Typographical Errors
We reserve the right to refuse or cancel orders placed at an incorrect price due to typographical errors, whether or not confirmed and charged. If charged, we will issue a credit for the incorrect amount.
Miscellaneous
If any provision is unenforceable, the remainder of these Terms of Use remains in effect. We may seek injunctive or equitable relief for any breach. THE Levels operates from Ukraine, and the Service is not intended for use in jurisdictions where it would violate local laws. You are responsible for compliance with local laws. These Terms of Use and the Privacy Policy constitute the entire understanding and cannot be modified by you.

Our Service and its contents, including AI-generated results, are provided "as is" without any warranty or representations. We do not guarantee the accuracy, reliability, or currency of any information or content, including test scores or assessments. We are not liable for any damages arising out of the use of the Service or its contents.
